Dealing With Adjusters
After an accident, you will get a call. The person on the other end is trained to save their company money. Here is how to handle it.
The Adjuster's Goal
Whether they are friendly or stern, never forget: The adjuster works for the insurance company. Their job is to settle the claim for the lowest possible amount that is legally justifiable.
What To Say
Be polite, calm, and stick to the facts (Who, What, Where, When). Provide:
- The basic facts of the crash.
- Photos of the damage.
- Police report number.
What NOT To Say
Soft tissue injuries (whiplash) can appear days later. If you are recorded saying "I'm fine" immediately after the crash, they will use that recording to deny medical claims later. Instead say: "I am going to see a doctor to get checked out."
- Don't Speculate: Don't guess how fast you were going. Say "I don't know" if you aren't 100% sure.
- Don't Admit Fault: Even a simple "I'm sorry" can be interpreted as admitted liability. Let the police and evidence determine fault.
The "First Offer" Trap
Adjusters often make a quick settlement offer to "get this behind you." Do not accept the first offer immediately. It is almost always lower than what you are entitled to. Wait until your medical treatment is finished so you know the full cost.
